Spain as a country signatory to the International
Civil Aviation Convention ICAO (Chicago 1944) allows all civil aircraft
registered in the countries signatoring to the above agreement to overfly
and make technical stops in the Spanish Territory.
Previous authorization from the Dirección General de Aviación
Civil shall be required for the purposes of operating non-scheduled commercial
traffic with Spain, except in the cases refered to in the next paragraph.
Spain, as a state signatoring to the Multilateral
Agreement on Commercial Rights of the European Non-Scheduled Air Services
(1956), grants the right to operate flights for the purpose of taking
on or discharging passengers, cargo or mail in aircraft registered in
the states contracting party to the aforementioned Multilateral Agreement
and operated by nationals of such states, provided these flights are included
in the following categories of non-scheduled flights:

Flights operated for humanitarian needs or on an emergency
case. |

b. |
Aerotaxies. |
 |
c. |
Flights on the whole capacity is chartered by one
single person (individual or entity person) for the transport of its staff
or goods. |
 |
d. |
Occasional flights.
Aircraft registered in countries contracting party to the above mentioned
Multilateral Agreement operated by nationals of such states are allowed
to operate in Spain non-scheduled flights provided they conform to the
following categories and are carried out according to the third and fourth
freedom. |

e. |
Cargo flights. |
 |
f. |
Aircraft on the whole capacity is chartered by one
single person (individual or entity person, except travel agencies) for
the transport of passengers and cargo of interest to the charterer for
other reasons than those specified in paragraph c). |

g. |
Flights carried out for the transport
of students.
|
 |
h. |
Special event charters. |
 |
i. |
Inclusive Tour Charters (ITC). |
In any case, details of the flight characteristics
should be indicated in the request for authorization and considered by
the Dirección General de Aviación Civil.

Airlines usually operating non-scheduled flights to
the spanish territory should be properly registered and accredited by
the Dirección General de Aviación Civil. This requirement
is not necessary for airlines operating occasional flights.
Foreign non-scheduled airlines are required to present the following documents
to obtain acreditation:

Certificate of Competence of the Airline.

Certificate of Airworthiness of the Airlines Aircraft. |

Insurance policy (aircraft, passengers, cargo, responsability covering
third persons). |

Airline operations manual, in accordance with ICAO Annex 6. |
Any request for authorization of non-scheduled flights
as well as for accreditation should be forwarded directly by the carrier
or its representative to:

The request for authorization of flights shall be
made in writing (2 copies) by telegraphic message or via SITA and the
languages used will be Spanish or English, including following information:

Name of operator. |
 |
 |
Name and address of the charterer. |
 |
 |
Type of aircraft and registration marks. |
 |
 |
Dates and estimated times for arrival and departure. |
 |
 |
Place or places of embarkation/disembarkation of passengers and/or
load abroad. |
 |
 |
Kinds of the requested flight and number of passenger and nature and
quantity of cargo. |
 |
 |
Charter price. |
Information or application requests for a flight made
via telegraph or via SITA should include the following data:

Identification of the airline. |
 |
 |
Number or identification abbreviation of the message, if appropriate. |
 |
 |
Date and Time when the message was sent by the carrier.(Abbreviations-
Request for authorization: REQ / Flight information: INF) |

 |
Date of the flight and estimated time of arrival (UTC) at the Spanish
destination airport and estimated time of departure of the return flight.(In
case various Spanish airports are used on one single service the same
data is to be used for each one). |

 |
Route to be operated (plain language). |
 |
 |
Type of flight (according to the classification of these Rules) and
number of passengers to be disembarked and/or embarked |
 |
 |
Nature and weight of the cargo to unloaden or loaden. |
The requests made by commercial telegraph should include
the payment of the reply for an amount equal to the cost of the telegram.
It is advisable that the Base Program of the Airline for each season be
sent to the Dirección General de Aviación Civil three (3)
months prior to the estimated date of departure of the flight, in order
to coordinate the schedules in the most satisfactory way.
Nevertheless, any sporadic modification may be made in any moment before
the flight departure, though a minimum of 24 hours is recommended.
